The RETTOCAMME Craft store on Etsy received legal notice from the representative of a major beer company this week:
"__________ has been engaged by ________ to help control the use of its marks. You are receiving this letter because ___________ has received information that you are advertising and/or selling products bearing one or more of the __________ marks, or confusingly similar derivations thereof. We understand that the inclusion of the __________ marks on your products may have been an oversight. However, on behalf of _________, __________ must demand that you discontinue your advertisement and sale of these products."
Hopefully I have not offended anyone else in this manner. (I still have half a kitchen full of beer caps that would have otherwise ended up in a landfill!)
As a graphic designer I have a great appreciation for the effort that goes into creating an effective logo and did not intend to insult anyone's brand. I enjoy giving these images another life especially since they are usually purchased by an avid fan of the beer in question. -Emma

Wow! That legal department is so stupid. Unless that beer company is planning on making their own art out of their own bottle caps, they are not losing any money and the brand is spreading on its own.
ReplyDeleteNow that I think of it, Coca Cola has been unsuccessful in suing artists since artworks are exempt from this sort of lawsuit. I'm sure you don't want to deal with that though.
